By creating an account, starting a free trial, connecting third-party accounts, or using the Acquizen platform in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use Acquizen.
These Terms form a legally binding agreement between you ("you" or "User") and Acquizen ("Acquizen," "we," or "us").
Acquizen is a software and managed marketing platform designed for local businesses. Depending on your subscription and feature availability, Acquizen may provide:
Features may be added, changed, removed, or limited at any time, and some features may depend on the availability of third-party services, APIs, or integrations that are outside Acquizen's control.
You must be at least 18 years of age and legally able to enter into a binding agreement to use Acquizen.
You agree to provide accurate, current, and complete information when creating your account and to keep that information updated. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You agree to notify Acquizen immediately if you become aware of any unauthorized use of your account or any other security breach.
Acquizen may allow you to connect your accounts with third-party services, which may include Google, Meta/Facebook, Instagram, TikTok, YouTube, advertising platforms, messaging providers, domain providers, and other services.
When you connect a third-party service:
Acquizen is not responsible for the actions, policies, or availability of any third-party service.
Acquizen uses artificial intelligence (AI) to assist with content creation, including website copy, blog posts, social media content, images, advertising assets, recommendations, and automated workflows.
AI-generated output may contain errors, inaccuracies, or misleading information. You are responsible for reviewing all AI-generated content — particularly factual, legal, financial, regulatory, licensing, pricing, guarantee, or safety-related claims — before it is published or used in your business operations.
Acquizen does not guarantee the accuracy, completeness, or appropriateness of AI-generated content for any specific purpose.
You retain ownership of all business information and original materials you upload to Acquizen, including logos, images, text, and branding assets.
By uploading or providing content to Acquizen, you grant Acquizen the rights necessary to host, process, modify, display, and publish those materials as needed to provide the service, including displaying them on your generated website, social media accounts, and advertising materials.
AI-generated website content, graphics, copy, and other generated assets created by Acquizen for your business are licensed to you for your business use for as long as you maintain an active Acquizen subscription. Upon cancellation, you may request a copy of your website content, but Acquizen is not obligated to continue hosting or maintaining it.
Some assets used in your website or content — such as stock images, fonts, icons, or third-party APIs — may be subject to separate third-party licenses with their own terms and restrictions. Acquizen is not responsible for third-party licensing violations arising from your use of such assets outside the scope of the service.
Acquizen offers a 7-day free trial. During the trial period, you will not be charged for the Acquizen subscription.
Unless you cancel before the end of the trial period, your subscription will automatically begin at $99.99 USD per month. Subscriptions renew automatically each month until cancelled.
Advertising spend is separate from your Acquizen subscription. You are responsible for any advertising budget you set and approve. Third-party platform fees, domain registration fees, and other external costs are also separate from your Acquizen subscription.
To cancel your subscription, you may do so through your account settings or by contacting support. Cancellation will prevent future billing cycles but will not result in a refund of the current billing period unless required by applicable law.
Acquizen does not offer refunds for partial billing periods. If you cancel mid-cycle, you will retain access until the end of the current paid period.
If you use Acquizen's advertising features, you understand that:
Acquizen is not responsible for advertising platform decisions, policy changes, or account suspensions imposed by third-party advertising platforms.
Acquizen does not guarantee any specific outcomes, including but not limited to:
Results depend on many factors outside Acquizen's control, including market conditions, competition, search engine algorithms, platform algorithms, industry trends, and the quality of your business offerings.
You agree not to use Acquizen to create, publish, store, or distribute content that is:
Acquizen reserves the right to remove or refuse to publish any content that violates these Terms or that Acquizen reasonably believes may be harmful or unlawful.
By using Acquizen, you agree to receive operational and service-related communications, which may include:
You may opt out of certain non-essential communications through your account settings, but operational and billing communications may still be sent.
Acquizen's handling of your information is described in our Privacy Policy, which is incorporated into these Terms by reference.
The Acquizen name, logo, software, platform design, systems, branding, code, and proprietary functionality are the exclusive property of Acquizen and are protected by intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or create derivative works of the Acquizen platform without written permission. You may not use Acquizen branding in a way that implies sponsorship, endorsement, or partnership without an actual written agreement.
Acquizen may suspend or terminate your access to the platform if:
Acquizen will make reasonable efforts to notify you before suspension or termination where appropriate, but may act immediately in cases of security threats or illegal activity.
You may cancel your Acquizen subscription at any time through your account settings or by contacting support. Cancellation will stop future billing cycles.
Upon cancellation:
Acquizen strives to maintain reliable service but does not guarantee uninterrupted or error-free availability. The platform may experience downtime, delays, or disruptions due to maintenance, system updates, infrastructure issues, or factors outside Acquizen's control.
Many Acquizen features rely on third-party systems and APIs. Acquizen is not responsible for outages, changes, or limitations imposed by third-party services.
Acquizen is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Acquizen does not warrant that the platform will meet your specific requirements, that it will be error-free, or that results will be achieved through its use. Acquizen is a marketing and software service, not a legal, financial, or regulatory advisory service.
To the maximum extent permitted by law, Acquizen and its affiliates, officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the platform.
Acquizen's total liability for any claim arising from these Terms or your use of the platform shall not exceed the total amount you have paid to Acquizen in the three (3) months preceding the event giving rise to the claim.
You agree to indemnify and hold Acquizen and its affiliates, officers, employees, and contractors harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:
Acquizen may update these Terms from time to time. When material changes are made, Acquizen will update the "Last Updated" date at the top of this page and may notify active users through the platform or by email.
Your continued use of Acquizen after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should cancel your subscription and discontinue use of the platform.
